1. About these Gift Card Terms

These Gift Card Terms apply to Body Mind Worldwide Gift Cards purchased, received or used through the Body Mind Worldwide Platform.

By purchasing or using a Gift Card, you agree to these Gift Card Terms and, where applicable, our Terms and Conditions and Privacy & Cookie Policy.

Any specific conditions shown when purchasing or receiving a Gift Card also apply.

2. Purchasing a Gift Card

Gift Cards may be purchased through the available Gift Card functionality on Body Mind Worldwide.

The available Gift Card amounts, currencies, payment methods and purchasing options are shown before purchase.

You are responsible for checking the Gift Card amount and recipient information before completing your purchase.

A Gift Card becomes available for use after the purchase has been successfully completed and the Gift Card has been issued.

3. Using a Gift Card

An eligible Gift Card may be used toward eligible Bookings made through Body Mind Worldwide.

The Gift Card code must be entered or otherwise applied through the available checkout functionality.

The Gift Card balance is applied toward the amount payable for the eligible Booking.

A Gift Card cannot be used outside Body Mind Worldwide or paid directly to a Partner.

4. Gift Card balance

If the value of an eligible Booking is lower than the available Gift Card balance, the unused balance remains available for future eligible Bookings.

If the value of a Booking exceeds the available Gift Card balance, the remaining amount must be paid using an available payment method.

A Gift Card cannot be used for more than its remaining available balance.

5. Currency

Gift Cards may be issued in a particular currency.

Where a Gift Card is used for a Booking displayed or charged in another currency, currency conversion may apply where supported by the Platform.

Any applicable conversion and the amount ultimately applied to the Booking will be shown through the Platform where relevant.

6. Validity and expiry

The validity of a Gift Card and any applicable expiry date will be shown when the Gift Card is purchased or issued.

Body Mind Worldwide will not apply an expiry period or other restriction where doing so would conflict with mandatory applicable law.

Any remaining balance must be used within the applicable validity period, subject to rights that cannot legally be excluded.

7. Cancellations and refunds of Bookings

When a Booking paid wholly or partly with a Gift Card is cancelled, the cancellation and refund conditions applicable to that Booking determine whether a refund is due.

Where a refund is due for an amount originally paid using a Gift Card, that amount may be returned to the Gift Card or otherwise restored as an eligible Body Mind Worldwide balance, as communicated through the Platform and permitted by applicable law.

Any amount paid using another payment method will normally be refunded through the applicable payment process.

A refund will never exceed the amount actually paid for the relevant Booking.

Mandatory consumer rights remain unaffected.

8. Refunds of Gift Card purchases

Whether a Gift Card purchase itself may be cancelled or refunded depends on applicable law and the circumstances of the purchase.

Nothing in these Gift Card Terms limits any cancellation, withdrawal or refund right that cannot legally be excluded.

Where a refund of the Gift Card purchase is permitted, Body Mind Worldwide may require that the Gift Card has not already been redeemed or used.

9. Lost, stolen or compromised Gift Cards

Gift Card codes should be treated as valuable information and kept secure.

You should not publish or share a Gift Card code except with the intended recipient.

If you believe a Gift Card has been lost, stolen, compromised or used without permission, contact support@bodymindworldwide.com as soon as possible.

Where reasonably possible, Body Mind Worldwide may investigate the issue and restrict further use of the Gift Card.

We cannot guarantee recovery or replacement of a Gift Card balance that has already been validly redeemed before the issue was reported, except where applicable law requires otherwise.

10. Transfers and cash redemption

Gift Cards are intended to be used toward eligible Bookings through Body Mind Worldwide.

Unless required by applicable law, Gift Cards and their balances:

• cannot be redeemed or exchanged for cash;
• cannot be transferred to a bank account;
• cannot be used to purchase another Gift Card; and
• cannot be used outside the Body Mind Worldwide Platform.

A Gift Card may be given to another person as a gift unless specific conditions shown at purchase state otherwise.

11. Promotions, credits and referral rewards

Gift Cards are different from promotional credits, referral rewards, discounts and other promotional benefits.

Different conditions may apply to those benefits.

Whether a Gift Card can be combined with a promotion, discount, credit or referral reward depends on the conditions of the applicable promotion and the checkout options made available by Body Mind Worldwide.

12. Fraud and prohibited use

Gift Cards may not be purchased, obtained or used fraudulently, unlawfully or in violation of these terms.

Gift Cards must not be used to manipulate Bookings, payments, refunds, promotions, referral programs or other Platform functionality.

Body Mind Worldwide may temporarily restrict a Gift Card where there is a reasonable suspicion of fraud, unauthorized use, payment reversal or other misuse while the matter is investigated.

Where permitted by applicable law, fraudulently obtained or improperly issued balances may be cancelled or corrected.

13. Payment reversals and chargebacks

If payment for the purchase of a Gift Card is reversed, charged back or otherwise invalidated, Body Mind Worldwide may suspend or cancel the corresponding Gift Card or remaining balance to the extent permitted by applicable law.

If part of the Gift Card has already been used, Body Mind Worldwide may take reasonable measures to address the resulting outstanding amount, fraud or misuse.

14. Errors and corrections

If a Gift Card or balance is issued incorrectly because of a technical, administrative or payment error, Body Mind Worldwide may correct the error to the extent permitted by applicable law.

We may request information reasonably necessary to investigate a Gift Card purchase, redemption, balance or suspected error.

We will not knowingly remove a valid Gift Card balance without a legitimate reason.

15. Changes to the Gift Card program

Body Mind Worldwide may change, pause or end the Gift Card program or update these Gift Card Terms where reasonably necessary, for example because of changes to the Platform, payment systems, security requirements or applicable law.

Changes will not unfairly remove an already validly purchased Gift Card balance.

Where required by law, we will provide appropriate notice of material changes.

16. Relationship with our other terms

These Gift Card Terms apply in addition to the Body Mind Worldwide Terms and Conditions and Privacy & Cookie Policy.

The Terms and Conditions and the specific conditions applicable to a Booking continue to apply when a Gift Card is used to make a Booking.

Our Privacy & Cookie Policy explains how personal data is processed in connection with Gift Card purchases, recipients, payments, Bookings, fraud prevention and support.

These Gift Card Terms are governed by Dutch law, without limiting mandatory consumer rights that apply under the law of the country where you live.

Nothing in these terms excludes or restricts rights that cannot legally be excluded or restricted.
